  • We do not share your personal information with third parties without your written consent, except as required by law or in emergencies including but not limited to DCBS child abuse reporting standards, APS elderly abuse reporting standards, or duty to warn. 
  • Consumer data will not be shared with third parties for marking purposes.
  • We may share information with your healthcare providers or other professionals involved in your treatment.

  • Your information is kept confidential in accordance with HIPAA regulations and state laws.
  • We take reasonable measures to protect the confidentiality of your information from unauthorized access, use, or disclosure.

8. Changes to This Privacy Policy:

  • We may update this Privacy Policy periodically to reflect changes in our practices. We will notify you of significant changes via email or by posting a notice in our office.

9. Data Collection:

  • We collect your name, e-mail address, and mobile phone number when you sign up for SMS updates.  The information is collected via your intake documents through the HIPAA compliant SimplePractice platform.
  • MESSAGE AND DATA RATES MAY APPLY . Your mobile carrier may charge fees for sending or receiving text messages, especially if you do not have an unlimited texting or data plan. 

  • You can opt out of the SMS list at any time by texting, emailing, or replying STOP or CANCEL to support@betterlivingcounselingcenter.com or 859-233-8496. After unsubscribing, you will receive a final SMS to confirm you have unsubscribed and we will remove your number from our list within 24 hours.

10. Data Usage:

  • We use your data solely for you to communicate changes in schedule, insurances, and payment methods  As well as general correspondence regarding mental health needs. 

11. Data Retention:

  • You can opt of SMS services at any time, however, by law, your healthcare records will be stored in the HIPPA compliant platform SimplePractice for 10 years.  You can request a copy of your chart at any time via writing.

Terms of Use for Better Living Counseling Center LLC

1. Acceptance of Terms: By accessing or using the services provided by Better Living Counseling Center LLC ('we,' 'us,' 'our'), you agree to abide by these Terms of Use. If you do not agree, please refrain from using our services.

2. Services Provided: We offer a range of counseling services, including individual therapy, couples counseling, family therapy, and assessments. Our services may be subject to change, and we reserve the right to modify them at any time. Clients will receive appointment reminders via text message 24-hours prior to appointment time and standard messaging rates may apply.  Clients may opt out of appointment reminders by logging into their SimplePractice Portal.  Clients are able to contact their clinicians via text messaging to 859-233-8496 and text messages will be responded to at the clinician's earliest convenience.  Please do not text 859-233-8496 for emergencies as the line is not monitored 24/7.  In the event there is an emergency and you need assistance, 'reply HELP' and call 859-233-8496 to speak to a therapist.  In the event, a therapist is not available or it is after hours, the weekend, or holiday, please contact 911 or proceed to the nearest emergency room.  It is considered unethical by governing boards for therapy sessions to take place over text message. Message frequency varies. Message and data rates may apply. Reply HELP, SUPPORT, MORE, or INFORMATION for help. Reply OPT, STOP, CANCEL, or OUT to cancel. 

3. Client Responsibilities:

  • You agree to provide accurate and complete information during the intake process and throughout your counseling experience.
  • You are responsible for attending scheduled appointments and notifying us in advance if you need to cancel or reschedule.
  • You must comply with all applicable laws and regulations while using our services.

4. Confidentiality: We are committed to maintaining the confidentiality of your information in accordance with HIPAA regulations. However, there are limits to confidentiality, which will be explained during your initial session.

5. Payment Terms:

  • Fees for services will be discussed during your initial consultation. Payment is due at the time of service unless otherwise arranged.
  • You are responsible for your own insurance claims and for understanding your insurance benefits.

6. Termination of Services: We reserve the right to terminate services if we believe that it is in the best interest of the client or if there is a breach of these Terms of Use. You may also terminate your services at any time by providing us with written notice.

7. Limitation of Liability: Better Living Counseling Center LLC is not liable for any indirect, incidental, or consequential damages arising from the use of our services or inability to access them. Your decision to seek therapy is voluntary, and we are not responsible for the outcome of therapy.

8. Modifications to the Terms: We reserve the right to update or modify these Terms of Use at any time. Any changes will be effective immediately upon posting on our website or notifying clients via email. Continued use of our services following any changes signifies your acceptance of the new terms.

9. Governing Law: These Terms of Use shall be governed by and construed in accordance with the laws of the state in which Better Living Counseling Center LLC operates.
